The age of consent in Kentucky is 16 years old depending upon the relative ages of the two parties. Kentucky defines sex in KRS 510.010 in the following ways:

Deviate sexual intercourse
"...any act of sexual gratification involving the sex organs of one person and the mouth or anus of another..."

Sexual contact
"...any touching of the sexual or other intimate parts of a person done for the purpose of gratifying the sexual desire of either party"

Sexual intercourse
"...sexual intercourse in its ordinary sense and includes penetration of the sex organs or anus of one person by a foreign object manipulated by another person."

The following are laws in the state of Kentucky that we feel restrict the act of sex. These are victimless acts that are criminalized by someone trying to legislate their own morality. Some of these laws are rarely applied but as long as they are on the books they can be used to persecute people. If you live in Kentucky ask your state legislators to change these laws.

KRS 231.110 Conduct prohibited in places of entertainment
It is prohibited to allow "... persons of lewd or lascivious reputation to congregate in or about the premises...people to congregate there for immoral or unlawful purposes or to permit any man or woman who are not married to each other to occupy any cabin, cottage, or secreted room or place from which the view of the public is excluded..."

KRS 232.00 Nudist societies
"Each licensed nudist society shall be subject to reasonable inspection by the sheriff...shall have the right to go upon private property and gain access to the buildings or inclosures..." The owner... shall keep a register of names and addresses of members of the society...available for inspection by proper authorities..."

KRS 233.00 Abatement of houses of prostitution
"...house of prostitution means any building, erection or other place used for the purpose of lewdness, assignation or prostitution...are declared a nuisance, and shall be enjoined and abated."

KRS 402.005 Marriage
"...refers only to the civil status, condition, or relation of one (1) man and one (1) woman..."

KRS 402.020 Other prohibited marriages
"Marriage is prohibited and void... between members of the same sex..."

KRS 402.045 Same-sex marriage in another jurisdiction void and unenforceable
"A marriage between members of the same sex which occurs in another jurisdiction shall be void in Kentucky. Any rights granted by virtue of the marriage, or its termination, shall be unenforceable in Kentucky courts."

KRS 510.100 Sodomy
"...deviate sexual intercourse with a person of the same sex." is a class A misdemeanor.

KRS 529.020 Prostitution
"...engages or agrees or offers to engage in sexual conduct with another person in return for a fee." This is a class B misdemeanor.

KRS 529.040 Promoting prostitution in the second degree
Operating "...a house of prostitution or a prostitution business or enterprise involving prostitution activity by two or more prostitutes." is a class D felony.

KRS 529.050 Promoting prostitution in the third degree
Knowingly advancing or profiting from prostitution is a class A misdemeanor.

KRS 529.070 Permitting prostitution
Allowing a premises to be "...used for prostitution purposes" is a class B misdemeanor.

KRS 529.080 Loitering for prostitution purposes
Loitering or remaining "...in a public place for the purposes of engaging or agreeing or offering to engage in prostitution" is a class B misdemeanor.

KRS 530.010 Bigamy
Marrying "...another person knowing he has a husband or wife or knowing the other person has a husband or wife" is a class D felony.

KRS 531.010 Obscenity
Obscene matter is defined, "to the average person, applying contemporary community standards, the predominant appeal of the matter, taken as a whole, is to prurient interest in sexual conduct; and the matter depicts or describes the sexual conduct in a patently offensive way; and the matter, taken as a whole, lacks serious literary, artistic, political, or scientific value." Distribution of obscene matter is a class B or A misdemeanor.
